Terms of Service

Welcome to Trove Notes. These Terms of Service ("Terms") govern your access to and use of the Trove Notes website at trovenotes.com and the related memory-archive service delivered by SMS, email, and our web app (collectively, the "Service"), operated by Plymouth Labs LLC ("Plymouth Labs," "we," "us," or "our"). Trove Notes is a product of Plymouth Labs LLC.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Questions about these Terms can be sent to support@trovenotes.com.


1. Eligibility

You must be at least 18 years old to create a Trove Notes account. By signing up, you represent that you are 18 or older and that you have the legal authority to enter into these Terms. If you are creating an archive about a child, you represent that you are the child's parent or legal guardian.


2. What Trove Notes Does

Trove Notes provides a private memory-archive service. You send observations, photos, videos, and audio recordings about your child by text message (to the Trove Notes messaging number for your account, which routes each message to the correct child's archive), by email (to a dedicated email alias we provision for each child), or directly from the web app. We save what you send, organize it into a chronological archive, and once per year deliver a printable PDF of that year's memories to you. The Service also includes an optional AI-assisted feature that helps you draft longer reflective notes through a conversational interface, and lets you invite other adults (co-parents, grandparents, or other helpers) to contribute to your child's archive.

Adults you invite to contribute must accept these Terms and provide their own channel consent before they can add memories. You are responsible for ensuring you have the authority to invite them and that they have authority to submit content about your child.

The Service is provided "as is" and "as available." We make no guarantee that the Service will be uninterrupted, error-free, or that any specific memory will be successfully delivered, processed, or stored. We do, however, take reasonable measures to make the Service reliable.


3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and current account information.
  • Notify us promptly at support@trovenotes.com if you suspect unauthorized access to your account.
  • Not share your account credentials with others, or allow others to use your account.
  • Use the Service only for lawful purposes and in accordance with these Terms.

We reserve the right to suspend or terminate accounts that violate these Terms, that are used fraudulently, or that present a security or legal risk to Trove Notes or other users.


4. Messaging Channels

Trove Notes lets you send memories to your archive over SMS (text messaging), email, or directly through the web app. The email channel provides a dedicated per-child alias. The SMS channel uses a shared Trove Notes number that routes your messages to the correct child's archive based on your account and the child you name. SMS is governed by US carrier requirements and the terms below; email and the web app are governed by these Terms more broadly.

SMS

Trove Notes is a memory-archive service that uses SMS to receive your photos, audio, and text about your child, and to send you confirmations, prompts, and annual volume notifications. Message and data rates may apply. Message frequency varies (typically 1–10 messages per week). Reply STOP to opt out at any time. Reply HELP for assistance, or email support@trovenotes.com.

These SMS-specific terms apply to your use of the text-message channel that delivers the core Service.

Opt-In

By providing your mobile phone number during account signup and confirming your subscription, you expressly consent to receive recurring SMS messages from Trove Notes related to the Service. Your consent is not a condition of any purchase made outside the Service.

Message Types You Will Receive

  • Transactional confirmations when we save a memory you sent.
  • Periodic prompts inviting you to share recent memories about your child.
  • Annual volume notifications when your yearly archive PDF is ready.
  • Account and billing notifications, such as payment failures or trial-ending reminders.

Message Frequency

Message frequency varies based on your usage of the Service. A typical user receives between 1 and 10 messages per week.

Costs

Message and data rates may apply. Trove Notes does not charge you for the messages themselves; standard rates from your wireless carrier apply. Check with your carrier for details on your messaging plan.

Opt-Out

You can opt out of SMS messages at any time by replying STOP to any Trove Notes message. You will receive a single confirmation message that no further messages will be sent. After opting out, you will no longer receive Service-related SMS, which means the core archive feature will not function. You can resume SMS by replying START, or by re-enabling SMS in your account settings.

Reply HELP to any Trove Notes message to receive contact information, or email support@trovenotes.com for assistance.

Carriers

Carriers, including but not limited to AT&T, Verizon, T-Mobile, and their affiliates, are not liable for delayed or undelivered messages.

Supported Carriers

The Service supports all major US wireless carriers. International numbers are not currently supported.

Email

When your child's archive has an email channel enabled, we provision a dedicated email alias for that child (in the form {slug}-archive@in.trovenotes.com). Any verified adult member of the archive can email memories to that alias and we will save them.

Opt-In and Sender Verification

The email channel uses the email address on your account as the sender identity. Memories sent from an unverified address are discarded. By signing up with a verified email address, you consent to send memories on this channel and to receive confirmation replies and Service-related email at that address.

Costs

There are no per-message fees for the email channel. Trove Notes does not charge you for the messages themselves. Your email provider's standard terms apply.

Opt-Out

You can disable the email channel for an individual child from your account settings at any time. Disabling the email alias does not affect SMS or your ability to add memories from the web app. Transactional emails essential to your account — billing receipts, security notices, magic links, and annual volume notifications — will continue to be sent as long as your account is active.


5. Your Content

You retain full ownership of the memories, photos, videos, audio recordings, conversations, and any other content you submit to Trove Notes ("Your Content"). Plymouth Labs LLC makes no claim to your content beyond what is necessary to provide the Service to you.

You grant Plymouth Labs LLC a limited, non-exclusive, royalty-free license to host, store, process, and display Your Content solely for the purpose of providing the Service to you and to people you authorize (such as a co-parent you invite to your archive). This license ends when you delete Your Content or your account.

You represent and warrant that:

  • You own or have the legal right to share all content you submit to Trove Notes.
  • Your Content does not violate any third party's rights, including privacy, publicity, copyright, or trademark rights.
  • You are the parent or legal guardian of any child whose information appears in Your Content.

You are responsible for Your Content. Plymouth Labs LLC is not responsible for content submitted by users.


6. AI-Assisted Drafting

The Service includes an optional feature that allows you to have a conversation with an AI assistant, which can then draft a longer reflective note in your voice based on the conversation. When you use this feature:

  • Your conversation transcript and relevant archive entries are transmitted to our AI provider (Anthropic) to generate the draft.
  • The draft is presented to you for review. You can accept, edit, or discard it. Nothing is added to your archive without your approval.
  • We do not use your content to train AI models.

You acknowledge that AI-generated text may contain inaccuracies, and you are responsible for reviewing drafts before approving them.


7. Subscription, Billing, and Refunds

Trove Notes is a subscription service. By starting a paid subscription:

  • You authorize Plymouth Labs LLC (via our payment processor Stripe) to charge your payment method the applicable subscription fee on a recurring basis.
  • Your subscription will automatically renew at the end of each billing period unless you cancel.
  • You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.
  • We may offer a free trial period at our discretion. If you do not cancel before the trial ends, you will be charged the regular subscription fee.
  • Before your first charge, we present the subscription price, billing frequency, and renewal terms, and you affirmatively consent to the recurring charge. If your subscription began with a free trial, we send a reminder before the trial converts to a paid subscription.

Refunds

Subscription fees are non-refundable except where required by law. If you believe you were charged in error, contact support@trovenotes.com within 30 days of the charge and we will review your request in good faith.

Price Changes

We may change subscription prices from time to time. We will notify you at least 30 days before any price change takes effect. If you do not agree to the new price, you can cancel before it takes effect.

Gift Subscriptions

Trove Notes may be purchased as a gift. When it is:

  • The parent or legal guardian who redeems the gift is the account holder and the data controller for the child's archive. The redeeming parent must accept these Terms and the Privacy Policy.
  • The gifter is the payer only. The gifter has no access to, and no rights over, the child's archive or its content, and receives only gift-status and delivery updates.
  • A gift funds a fixed term and does not auto-renew. It converts to a recurring paid subscription only if the parent adds a payment method and affirmatively consents to the recurring charge, as described above.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Submit content that is illegal, threatening, abusive, harassing, defamatory, obscene, or that infringes on any third party's rights.
  • Attempt to gain unauthorized access to other users' accounts, our systems, or any data not belonging to you.
  • Reverse engineer, decompile, or attempt to extract the source code of any part of the Service, except where this restriction is prohibited by applicable law.
  • Use the Service to send spam, phishing attempts, or any other unsolicited communications.
  • Resell, sublicense, or commercially exploit the Service or any portion of it.
  • Use automated means (bots, scrapers, etc.) to interact with the Service in ways that disrupt or burden our infrastructure.
  • Submit content about anyone (including a child) for whom you do not have legal authority to do so.

We may review content where we have a legal obligation or a good-faith belief that review is necessary to comply with the law or protect users. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) as required by law.

Violation of these prohibitions may result in immediate termination of your account.


9. Termination

You may close your account at any time from your account settings. Upon closure, your data will be deleted in accordance with our Privacy Policy.

We may suspend or terminate your account, with or without notice, if you violate these Terms, if your account presents a security risk, if we are required to do so by law, or if we discontinue the Service.

Sections of these Terms that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and dispute resolution — will continue to apply after termination.


10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY SPECIFIC MESSAGE OR PIECE OF CONTENT WILL BE SUCCESSFULLY DELIVERED, STORED, OR PROCESSED.

WHILE WE TAKE REASONABLE MEASURES TO BACK UP AND PROTECT YOUR CONTENT, YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN COPIES OF ANYTHING IMPORTANT TO YOU. WE STRONGLY RECOMMEND THAT YOU PERIODICALLY DOWNLOAD AN EXPORT OF YOUR ARCHIVE.


11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PLYMOUTH LABS LLC, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID PLYMOUTH LABS LLC IN THE 12 MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in full.


12. Indemnification

You agree to indemnify, defend, and hold harmless Plymouth Labs LLC and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any third party's rights.
  • Any content you submit to the Service.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last Updated" date at the top of these Terms. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service and may close your account.


14. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Virginia, and you consent to the personal jurisdiction of those courts.

You and Plymouth Labs LLC agree to attempt in good faith to resolve any dispute informally before initiating any formal proceeding. To begin, contact support@trovenotes.com with a description of the dispute and your contact information.


15. Copyright and Takedown

If you believe content on the Service infringes your copyright, contact our designated agent at support@trovenotes.com with: your contact information; identification of the copyrighted work; identification of the allegedly infringing material and where it is located; a statement that you have a good-faith belief the use is unauthorized; a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and your signature. We respond to valid notices, may remove infringing content, and may terminate repeat infringers.


16. Miscellaneous

Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and Plymouth Labs LLC regarding the Service.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No Waiver. Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
